County of Inyo Board of Supervisors |
August 14, 2007
The Board of Supervisors of the County of Inyo, State of California, met in regular session at the hour of 9:00 a.m., on Tuesday, August 14, 2007, in the Board of Supervisors Room, County Administrative Center, Independence, with the following Supervisors present: Chairperson Jim Bilyeu presiding, Linda Arcularius, Susan Cash, Beverly Brown, and Richard Cervantes. Supervisor Bilyeu provided the Invocation, and Supervisor Cervantes led the Pledge of Allegiance .
Public Comment |
The Chairperson announced the public comment period. Ms. Mary Canada of the Sierra Business Council, updated the Board on the Council’s activities in the region, including an upcoming mining conference, a conference to be held in Bishop on sustainable forestry, Leadership Training, and the Museum and Interpretive Center pamphlet. Ms. Canada explained that the Museum and Interpretive Center promotion was a collaborative effort funded by multiple jurisdictions, including Inyo County. She went on to apologize for the omission of the Big Pine and Independence Chambers of Commerce contact information on the back of the pamphlet. Supervisor Cervantes solicited donations for the Boy Scouts of America. Ms. Arlene Grider, Independence Chamber of Commerce, presented the Board with the inaugural edition of the Inyo County Visitor’s Guide, noting this is a Coalition of Chamber’s project funded with the help of a Forest Service grant and the County’s funding of the Chambers. |
County Dept. Reports |
The Chairperson announced the County Department Report period. The County Administrator announced that there would be a Household Hazardous Waste Event conducted this Saturday at the Independence Landfill from 9:00 a.m. to 12 noon. |
Resol. #2007-41/ Title III Funds Designation |
On a motion by Supervisor Cash and a second by Supervisor Cervantes, Resolution No. 2007-41, entitled “A Resolution of the Board of Supervisors, County of Inyo, State of California for the Designation of 15% to 20% of the Safety Net Full Payment Amount to be Allocated to Local Projects,” was approved: motion unanimously passed and adopted.

CAO-Purchasing/ Printing Bid |
Moved by Supervisor Cash and seconded by Supervisor Cervantes to award Bid No. 2006-01, Printing for FY 2007-08 to the Hanigan Company and authorize purchase orders to be approved for various County Departments to order printing from this bid for FY 2007-08. Motion carried unanimously.

HHS-Hlth Serv./ Declaration of Intent Not to Apply |
Moved by Supervisor Cash and seconded by Supervisor Cervantes to approve the FY 2007-08 “Declaration of Intent Not to Apply” for Rural Health Services Funds; and authorize the Chairperson to sign. Motion carried unanimously.

Planning-Yucca Mt./Latir Energy Board Order Amendment |
Moved by Supervisor Cash and seconded by Supervisor Cervantes to amend the Board Order dated May 8, 2007 approving the Contract between the County of Inyo and Latir Energy Consultants, to correct the contract not to exceed amount from $78,000 to $79,800. Motion carried unanimously.

E. Hlth/Workshop on Fees |
The Chairperson recessed open session at 9:15 a.m., to convene in a workshop, with all Board Members present, with the Director of Environmental Health on Environmental Health fee increases. The Chairperson recessed the workshop at 10:50 a.m., to reconvene in open session, with all Board Members present. |
P.W./ESRA Taxiway Project Bid Award |
The request by the Public Works Director for the award and approval of the Contract for the Eastern Sierra Regional Airport Taxiway A, F, H, and Apron Improvement Project was pulled from consideration at the request of the Department. |
Grand Jury/2007 Report Board Response |
Moved by Supervisor Cash and seconded by Supervisor Arcularius to approve the report to Judge Dean Stout, Presiding Judge, Inyo County Superior Court, responding to the findings and recommendations for the 2006-2007 Grand Jury Final Report and authorize the County Administrator to sign the transmittal letter. Motion carried unanimously.

CAO/Surplus Land Policy |
The County Administrator noted that County Counsel had entitled the policy the Real Property Management Policy and the Agenda referenced the working title of Surplus Land Policy, and asked that if adopted the policy be titled the “Real Property Management Policy.” The County Administrator briefly described the procedure and noted that if adopted the Policy would require an inventory of County owned property, which he intends to conduct as soon as possible. Moved by Supervisor Brown and seconded by Supervisor Cash to approve the “ Real Property Management Policy.” Motion carried unanimously. |
CAO/Unanticipated Revenue Policy |
The request for the Board to consider a policy dealing with the use of unanticipated revenue was pulled at the request of the County Administrator. |
BofS/Minute Approval |
Moved by Supervisor Cash and seconded by Supervisor Arcularius to approve the minutes of the Board of Supervisors Meetings of A) the Special Meeting of August 2, 2007 and B) the Regular Meeting of August 7, 2007. Motion carried unanimously.

Org./Arts Council Millpond Closure |
Supervisor Brown declared a conflict because her spouse works for the Company that has the Millpond concession and left the meeting. Moved by Supervisor Arcularius and seconded by Supervisor Cervantes to authorize that Millpond Recreation Area be closed to the public from 6:00 p.m., Friday, September 14, 2007 through midnight Sunday, September 16, 2007, for the Millpond Music Festival. Motion carried unanimously, with Supervisor Brown absent. At the conclusion of this Item, Supervisor Brown rejoined the meeting.

The Board Members reported on their activities during the preceding week, including a meeting held at the Wellness Center, the upcoming Wild Iris Run, an IMAAA Meeting, a legislative update, an update on the 395 4-laning projects, and a reminder of the upcoming budget hearings.

The Chairperson recessed open session at 12:30 p.m., to convene in closed session, with all Board Members present, to address Agenda Items No. 14. The Chairperson recessed closed session at 3:00 p.m., to reconvene in open session, to receive a report on closed session. County Counsel reported there were no items discussed in closed session, which were required by law to be reported on in open session.

Adjournment |
The Chairperson adjourned the regular meeting in memory of two long-time County residents, Mr. Conrad “Connie” Johnson and Mr. Richard Muldoon. The Chairperson adjourned the meeting at 3:00 p.m., to 9:00 a.m., Tuesday, August 21, 2007, in the Board of Supervisors Room, at the County Administrative Center, in Independence.
